ELECTRONIC BOOKING AGREEMENT
Booking Terms and Conditions
Version 2026-08-cancellation-v1
Please read these terms before signing. They form part of the event booking submitted to Finca America.
1. Estimate, review, and confirmation
The online total is an estimate based on the date, guest count, experience, service style, venue, and enhancements selected. The request is not finally accepted until Finca America confirms availability and scope. A date is held or confirmed only as stated in the proposal and payment communications.
2. Payments
The secure deposit shown at checkout is applied to the event total. Remaining payments are due on the dates communicated in the confirmed proposal. Taxes, approved additions, venue requirements, overtime, and third-party costs may change the final balance.
3. Client changes
Date, venue, guest count, menu, service, or timing changes require written approval and may change price, staffing, availability, and production. Reductions requested after purchasing or production has begun may not reduce the balance.
4. Cancellation requested by the client
Cancellation must be requested in writing. The applicable tier is determined by calendar days between the recorded request and the event date. The percentage applies to payments actually received:
• 30 days or more before the event: 10% of payments received is retained
• Between 15 and 29 days before the event: 50% of payments received is retained
• Between 8 and 14 days before the event: 75% of payments received is retained
• 7 days or fewer before the event: 100% of payments received is retained
Any suggested refund is reviewed before funds are returned. Approved nonrecoverable third-party purchases or custom work expressly authorized by the client may also be deducted where permitted.
5. Cancellation or disruption by Finca America
If Finca America cannot perform for reasons within its control, the client will receive a refund of amounts paid for services not provided. For events beyond either party’s reasonable control, both parties will first attempt in good faith to reschedule or adjust scope; any refund will account for services already performed and approved nonrecoverable commitments, as permitted by law.
6. Guest count, access, and timing
The client must provide accurate guest, venue, parking, access, setup, power, water, elevator, and timing information. Final production quantities follow the last written count accepted by Finca America. Delays or conditions outside the agreed scope may require a written adjustment.
7. Allergies and food handling
All allergies and dietary restrictions must be disclosed in writing before production. Reasonable precautions are used, but a shared kitchen and shared supply chain cannot guarantee the complete absence of trace allergens. The client is responsible for safe handling after delivery or service completion.
8. Rentals, property, and conduct
The client is responsible for reasonable access and for loss or damage to rented or Finca America property caused by guests, venue personnel, or third parties, excluding ordinary wear. Finca America may stop unsafe or unlawful service without waiving amounts earned for work already performed.
9. Communications and electronic signature
The client agrees to receive booking records and notices electronically and may save or print this document. Typing the signer’s name and selecting the consent boxes is intended as an electronic signature associated with this booking. Records include the accepted text, version, date and time, email, IP address, browser information, and a tamper-evident hash.
10. Entire agreement and Florida law
The confirmed proposal, these terms, and later written changes form the agreement. If a provision is unenforceable, the remaining provisions continue to apply. Florida law governs, without limiting rights that cannot lawfully be waived. Contact Finca America before signing if any term is unclear.
